HHJ Norton's sentencing remarks stated:
"Dr Brown said that not only had there had been two previous incidents in Manchester Trafford and Glasgow Silverburn in which injuries had resulted from barriers which had fallen, but there was now a pattern emerging, where it was clear that not only were there barriers that were unfixed, but barriers that were poorly fixed; and if barriers are not properly fixed, whether because they are freestanding or because the fixings are inadequate, then it is foreseeable that they will fall; and if they weigh 110 kilos, it is foreseeable that they will cause serious injury. I accept and agree with Dr Brown’s evidence.”
